Celebrities now share their sexual and romantic experiences with the public more openly, often on social media. Several celebrities have participated in the #MeToo movement, discussing traumatic experiences in their past. Many young people said having famous people lead such discussions on social media can both educate and mislead their followers about consent.
Before this campaign started, we talked with more than 100 NYC youths about how they navigate sexual consent. A change in the way that age-of-consent laws are examined in court. In many countries, there are specific laws dealing with child prostitution. The Council of Europe Convention on Action against Trafficking in Human Beings also deals with commercial sexual exploitation of children. The Protocol to Prevent, Suppress and Punish Trafficking in Persons, especially Women and Children, which came into force in 2003, prohibits commercial sexual exploitation of children. Several articles written by British investigative journalist William Thomas Stead in the late 19th century on the issue of child prostitution in London led to public outrage and ultimately to the raising of the age of consent to 16.
At that moment, it was discovered that 37 other cases involving violent crimes occurred at that university during the last 3 years. This is how the Clery Act law requires institutions to disclose, publish and distribute their data and statistics on violent episodes. Communicative acts, beyond words, need to be considered for ensuring consent for any sexual activity.
Some individuals are unable to give consent, or even if they can verbally indicate that they consent, they are deemed to lack the ability to make informed or full consent (e.g., minors below the age of consent or an intoxicated person). In Canada “consent means…the voluntary agreement of the complainant to engage in sexual activity” without abuse or exploitation of “trust, power or authority”, coercion or threats. In many jurisdictions, sexual activity without consent is considered rape or other sexual assault.
Punishment for having sex with someone who is too young under the law is very serious. Depending on the situation, the punishment could be as much as 5 to 8 years in prison for a first offense. Also, a person convicted of any sexual crime may have to register with the police as a sex offender. No teenager can have sex with someone who is 4 or more years olderThe law also makes it a crime for a person in a position of authority over a younger person to have sex with the younger person. Two people who are both 16 or older can agree to have sex with each other. When a person involved in sex is under the age of 16, Alaska law looks at the difference in ages to decide whether that person is legally able to agree to sex.
Consent applies to anyone who can’t freely agree to sex, regardless of age. Older adults with dementia, such as Alzheimer’s disease, or who are dependent on other adults may be sexually abused because they’re unable to consent to sex. Some seniors in nursing homes may be dependent on their abusers for care and afraid to speak out, while others may be unable to communicate because of dementia or illness. If this happens, find a time speak to them in private but don’t push them to explain anything – just let them know you are willing to listen if they want to talk. If someone has had sex without a condom, speak to them about getting tested for sexually transmitted infections, including HIV, and accessing emergency contraception if they need to. These things might feel overwhelming, so it is a good idea to introduce them gradually, when the moment is right. Giving consent for one type of sexual activity doesn’t mean you’re giving consent to go further.

Proof of coercion does not require proof of a specific act or threat. “Physically helpless” means that a person is asleep or not conscious, unable to withhold consent or to withdraw consent because of a physical condition, or unable to communicate nonconsent and the condition is known or reasonably should have been known to the actor.
While celebrities like Bill Cosby, Harvey Weinstein, and Kevin Spacey may have kick-started the conversation about consent, the reality is that 1 in 3 women and 1 in 6 men in the United States experience sexual violence in their lifetime. Communication, honesty and respect make sexual relationships better. Asking for and getting consent shows respect for yourself and your partner. Consent to engage in sexual activity with one person does not imply consent to engage in sexual activity with another.
